If you're facing domestic abuse:

  1. Go to the nearest police station.
  2. Bring someone supportive.
  3. Tell the police you want to report domestic abuse.
  4. They should give you a form (J471E Click the icon below to download). If not, ask for it.
  5. If you need a protection order, ask for form (J480E Click the icon below to download).
  6. Complete the form, get it signed by a Commissioner of Oaths, then take it and your ID to the Clerk of the Court.
  7. If the police don't help, show them this page. If they still refuse, report them to SAPS GBVF-related Service Complaints (Click the icon below to visit the website).
  8. The Magistrate will decide on an Interim Protection Order (IPO) if needed.
  9. If abuse continues, get a Final Protection Order (FPO). The court will send it to the police.
  10. Breaching an IPO or FPO is a crime.
  11. You can ask for extra help in the orders, like emergency money or police assistance to collect your things.

What is Abuse:

Abuse comes in many forms: physical, sexual, emotional, verbal, economic, intimidation, harassment, stalking, damaging property, and even entering your home without permission. None of it is justified.

What is Domestic Violence:

Domestic Violence affects so many people, and sadly, it's often brushed off as a normal part of relationships. This misconception is what we call ' normalisation '. But we can change that. By speaking out, educating ourselves, our kids, and others about domestic violence, we can put an end to this normalisation and fight for equality in our families and communities.

What is a Protection Order?

A protection order is like a safety plan to prevent bad things like domestic violence or harassment from happening again. It sets boundaries for the person causing trouble and ensures safety for the person seeking protection.

How to Apply for a Protection Order:

  • Go to the police station, fill out a form, and provide a detailed statement (affidavit).
  • Get supporting affidavits from witnesses or others who know about the situation.
  • Submit these documents to the nearest court clerk for immediate review.
  • Seek assistance from counsellors, doctors, social workers, teachers, or police officers in applying for the protection order.

Temporary Protection Order:

  • If the court finds enough evidence of harm, they'll grant a temporary protection order immediately to ensure immediate safety.

Final Decision:

  • You'll need to attend another court hearing where the person causing trouble can contest the protection order.

Enforcing the Protection Order:

  • The protection order outlines specific prohibitions, such as proximity to you, your home, or workplace, and contact with any involved children.
  • You can request the removal of the person's dangerous items, like firearms, with court approval.
  • If the person violates the protection order, notify the police immediately, as only a judge can take further action.
